Insolvency legislation restricts company directors or insolvency practitioners from allowing one creditor to be paid ahead of another as this is considered a preference payment. However, a professional adviser has the skill set to assist an insolvency practitioner with the administration of an insolvency appointment and therefore can often get paid from the insolvency estate for certain further services done. This can include the preparation of a Statement of Affairs, bringing accounts up to date (for investigative or claim purposes) or even the production of records to assist with the debt collection.
